These Terms of Service (“Terms”) govern your access to and use of the JustSpinWheel website and related tools (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
JustSpinWheel offers browser-based spin wheels and random pickers for entertainment, education, and informal decision support. Outcomes are probabilistic. The Service does not provide legal, medical, financial, or other professional advice. You are solely responsible for how you interpret or act on results.
2. Eligibility
You must be able to form a binding contract in your jurisdiction. The Service is not intended for users under the age of 13 (or the higher age required locally). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Acceptable use
You agree not to:
- use the Service for unlawful, harmful, fraudulent, or harassing purposes;
- attempt to gain unauthorized access to our systems, other users, or third-party services;
- introduce malware, excessive automated traffic, or activity that degrades performance or security;
- scrape, copy, or redistribute substantial parts of the Service in violation of these Terms or applicable law;
- misrepresent random outcomes as guaranteed, certified, or endorsed by us when they are not;
- use the Service in competitions or regulated activities where our tool does not meet applicable rules, unless you verify compliance yourself.
4. User content and shared links
You retain rights to text you enter. You grant us a limited license to process such content solely to operate the Service (e.g. rendering the wheel in your browser). Shared URLs may expose your labels to others; you are responsible for the content you share.
5. Advertisements
The Service may display third-party advertisements (including via Google AdSense). We do not control third-party ads or sites. Your dealings with advertisers are solely between you and the advertiser. See our Privacy Policy for how data may be used in connection with ads.
6. Intellectual property
The Service, including its design, branding, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer our proprietary materials except as allowed by law or with our written permission.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR FREE USE) OR (B) FIFTY U.S. DOLLARS (USD $50), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
9. Indemnity
You will defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.
10. Changes and termination
We may modify the Service or these Terms at any time. Material changes will be indicated by updating the “Last updated” date. We may suspend or discontinue the Service with or without notice. Provisions that by their nature should survive will survive termination.
11. Governing law and disputes
Unless mandatory local law requires otherwise, these Terms are governed by the laws of the jurisdiction in which the operator of this deployment is established, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive venue, subject to non-waivable rights you may have as a consumer.
